Consent to Electronic Communications and Disclosures
In this Consent to Electronic Communications and Disclosures (“ESIGN Consent”), the terms
“we,”us,” “our” and “Bank” mean MRV Banks, a Missouri-chartered state bank and any of its
subsidiaries, successors, assigns, or service providers. “You” and “your” mean the individual
agreeing to this ESIGN Consent. "Account" means a loan or credit account with the Bank.
In connection with any account inquiry or account transaction, we may be required by law to
provide you certain information in writing. By agreeing to this ESIGN Consent, you agree to
receive information, including all communications, agreements, documents, periodic monthly
statements, notices and disclosures (collectively, “Communications”) from us electronically.
Scope of Communications:
Your consent gives permission for us to communicate with you electronically during the course
of our relationship with you, including, without limitation, regarding any of our products and
services you currently use, may use in the future, or inquire about using, and that may be
accessed through our website or mobile application. You agree that we may send all
Communications to you electronically unless and until you withdraw your consent as described
below. Communications also includes, as applicable:
Any disclosures or other information provided to you about your account inquiry or
account offers, including, but not limited to, your interest rate, finance charges, APR, any
adverse action taken in connection with your account, and any final terms and conditions
of your account;
Any information provided to you about any product, service, or transaction in connection
with your account;
Any terms and conditions and policies related to your account, including, without
limitation, privacy policies, notices about a change in the terms of your account or
associated payment features, responses to claims, and other authorizations you provide;
Any documents or disclosures we provide to you, including, but not limited to disclosures
provided pursuant to the Equal Credit Opportunity Act and Regulation B; the Truth in
Lending Act and Regulation Z; the Gramm-Leach-Bliley Act and Regulation P; the
Electronic Fund Transfer Act and Regulation E; and any other applicable federal, state,
or local law, or regulation; and
Any other information relating to your relationship with us.
We will provide these Communications to you by posting them on the website or mobile app
after you log-in, and/or by emailing them to you at your registered email address. It is your
responsibility to keep your registered email address up to date so that we can communicate with
you electronically. At our option, we may treat your provision of an invalid email address, or the
subsequent malfunction of a previously valid email address, as a withdrawal of your consent to
receive electronic Communications.
How to Request Paper Copies
You have the right to request paper copies of any electronic Communication. We may charge
you a fee of up to $10 for each paper copy you request. Paper copies can be requested by
calling 833-690-2471 during our operating hours (8:00am to 5:00pm CT), each Monday through
Friday that are business days for MRV Banks. We reserve the right, but assume no obligation,
to provide a paper (instead of electronic) copy of any Communication that you have authorized
us to provide electronically. Please note that a request for a paper copy of any Communication
will not by itself constitute a withdrawal of consent to receive Communications from us
electronically.
Hardware and Software Requirements
In order to access and retain electronic Communications, you will need: a computer with an
Internet connection; a current web browser that includes 128-bit encryption and with cookies
enabled (e.g. Microsoft Edge version 9.0 and above, Firefox version 87.0 and above, Chrome
version 89.0 and above, or Safari 13.0 and above); a mobile phone using either iOS 14 and
above or Android 8.0.0 or above; a valid email address; and sufficient storage space to save
Communications or an installed printer to print Communications. You confirm that you have
access to the necessary equipment and software to receive and save/print our Communications
to you.
How to Withdraw Consent and Update Your Records
You may withdraw your consent to receive Communications electronically, or update
information needed to contact you electronically, by emailing us at help@coign.com or by calling
us at 833-690-2471 during our operating hours 8:00am to 5:00pm CT, each Monday through
Friday that are business days for MRV Banks; or by writing to us via regular mail at 9812 Falls
Road #114-287, Potomac, MD 20854-3963. You must notify us of any update or change in your
contact information promptly. Any withdrawal of your consent to receive electronic
Communications will be effective only after we have a reasonable period of time to process your
withdrawal. If you withdraw your consent to receive Communications electronically prior to
completing your application for an account, you will not be able to complete the application
process and therefore will not be issued an account. If permitted by applicable law and if you
withdraw your consent to receive Communications electronically after completing an account
application, we reserve the right to charge you a fee of up to $10 for each paper Communication
provided to you after you have withdrawn your consent.
Consent
By checking "I have read, understand, and agree to the ESIGN Consent." you hereby (i) confirm
to us that you can access and read this information electronically, which will be similar in form
and format to electronic Communications we provide to you; (ii) confirm that you are able to
print on paper or electronically save this ESIGN Consent and other Communications for your
future reference; (iii) give your affirmative consent to receive electronic Communications as
described herein; (iv) agree that you have provided us with a current e-mail address and other
contact information to which we may send electronic Communications to you; and (v) agree to
promptly notify us of any change to your email address or other information needed to contact
your electronically.
